Cake4Kids Privacy Policy

Thank you for reviewing Cake4Kids’s (collectively, “Cake4Kids”, “we”, “us” or “our”) Privacy Policy for our website located at https://www.cake4kids.org and our services that provide cakes to underserved children (collectively, our “Service”).  This Privacy Policy details our collection and use of personally identifiable information about users of our Service. When we refer to ‘cakes’ in this Privacy Policy, we are referring to cakes, bars, cookies, brownies, cupcakes etc.

By using the Service, you signify your assent to this Privacy Policy and agree to comply with all applicable laws and regulations. If you do not agree with this Privacy Policy, do not access, or otherwise use our Service.

Privacy Policy Updates

Cake4Kids may need to update this Privacy Policy from time to time. If so, we will post the updated Privacy Policy on the Service. Cake4Kids may also send registered users that have provided us with their email address an email notification notifying such users of any changes to the Privacy Policy. Cake4Kids encourages you to review this Privacy Policy regularly for any changes. Your continued use of this Service, and/or continued provision of personally identifiable information to us, will be subject to the terms of the then-current Privacy Policy.

Information Collection and Use

When you submit a request to volunteer, we will collect your name, email, address, date of birth, phone number, driver’s license number, and insurance information. If you submit a request to volunteer as a parent/child team (for children 16 and over only), we also collect your child’s name, their date of birth, and email address.

If you are a program manager or social worker (or other adult individual) requesting a cake for a child, we collect your name, email, phone number, address, and the following information about the child: name, gender, date of birth, delivery address (must be an agency, not child’s home), allergy information, and preferred cake type.

We also collect photos of individuals that volunteer for us and/or that receive our cakes that you choose to submit to us. By submitting a photo to us, you agree that you have the rights to do so.

If you contact us with questions or to request information, we will collect the personally identifiable information that you voluntarily transmit with your communications to us. We also may collect personally identifiable information about you that you elect to upload to the Service in addition to the information above.

We use your personally identifiable information to contact you to deliver information you have requested. We use the personal information to deliver the cakes that have been requested and to improve the Service. We may also send you information regarding our Service. If you do not wish to receive these emails from us, you may opt-out as set forth in certain messages you may receive from us or contact us at info@cake4kids.org.

Children's Privacy

You must be age 16 or older to register to volunteer on the Service and if you are between 16 and 18, your parent or guardian must register you. We accept requests for cakes from program managers, social workers, and other responsible adults. If you are a child that would like a cake, please contact your social worker or program manager to request a cake on your behalf.

Cake4Kids recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Service is not directed to, and does not target, children under the age of 16. Cake4Kids does not knowingly collect personally identifiable information from children under the age of 16. If your child has provided personally identifiable information, please contact us so we can delete it.

Cookies

Small text files called cookies are often use to improve overall Service experience. A cookie is a piece of data stored on the user's hard drive containing information about the user.

We and our third-party providers generally use functional, performance and analytics cookies session cookies as set forth at https://support.squarespace.com/hc/en-us/articles/360001264507-About-the-cookies-Squarespace-uses. These cookies help websites work better. They help us work behind the scenes to make your customer experience easier. You would miss a lot of these things if they were gone – such as keeping you logged in in and moving from page to page.

Aggregate Information

We track information that will be maintained, used, and disclosed in aggregate form. For example, without limitation, we may track the total number of visitors to our Service, the number of visitors to each page of our Service. We may analyze this data for trends and statistics in the aggregate, and we may use such aggregate information to administer the Service, and gather broad demographic information for aggregate use.

Do Not Track

We currently do not respond to do not track browser signals. We do not track users over time over multiple websites along with our website.

Disclosure

We may provide your personally identifiable information and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you for their use solely to provide us with such assistance. For example:

  • our Service is hosted by a third-party hosting provider, such as GoDaddy and Squarespace; and

  • we may use third parties to manage our email solutions, such as MailChimp.

These are third-party vendors, and their use of your personally identifiable information is subject to their respective privacy policy terms as well as written agreements restricting their use of the personally identifiable information for their own purposes.

We will also disclose your personally identifiable information (a) if we are required to do so by law, regulation, or other government authority or otherwise in cooperation with an ongoing investigation of a governmental authority, (b) to enforce the Cake4Kids terms or agreements or to protect our rights, or (c) to protect the safety of users or recipients of our Service.

We may transfer your personally identifiable information to a successor entity upon a merger, consolidation, or other corporate reorganization in which Cake4Kids participates or to a purchaser or acquirer of all or substantially all of Cake4Kids's assets to which this Service relates.

Security

We employ procedural and technological measures that are generally consistent with industry practice. Such measures are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration, or destruction. Cake4Kids may use encryption and password protection to help prevent unauthorized access to your personally identifiable information.

Updating Personally Identifiable Information

Cake4Kids provides Service users with the ability to review and update certain information that you provide to us by changing your information in the Cake4kids baker portal or by contacting us at info@cake4kids.org.

External Web Sites

The Service may provide links to other websites or resources over which Cake4Kids does not have control (“External Web Sites”). Such links do not constitute an endorsement by Cake4Kids of those External Web Sites. You acknowledge that Cake4Kids is providing these links to you only as a convenience, and further agree that Cake4Kids is not responsible for the content of such External Web Sites. Your use of External Web Sites is subject to the terms of use and privacy policies located on the linked to External Web Sites.

Users Outside of the United States

Our Service is targeted to users in the United States. Our computer systems and third-party hosting provider systems are currently based in the United States, so your personal data will be processed by us in the United States where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as Canada or the European Union. If you create a user account as a visitor from outside the United States, by using the Service you agree to this Privacy Policy and you consent to the transfer of all such information to the United States, which may not offer an equivalent level of protection of that required in certain other countries, and to the processing of that information as described in this Privacy Policy. In our discretion, we may adopt other

means, such as entering into Model Contract Clauses, or enter into different certification programs under applicable law for ensuring adequate safeguards.

The English text of this Privacy Policy constitutes the sole authentic text. If there is any discrepancy between the English text and a translation into a foreign language, the English text shall prevail.
